Two couples in Rancho Palos Verdes have sued the City of Rancho Palos Verdes claiming that any attempt to enforce the 20 year old view restoration ordinance is void under the statute of limitations. They claim that anyone filing to force their meighbors to trim or remove their trees to restore their pre-1989 views have now waited too long to attempt to enforce the ordinance.
The ordinance provides that homeowners can appeal to have trees removed from neighbors lots to resotre the views that were in existence when their lots were originally subdivided. Therefor, if a property was originally subdivided in 1961, owners could appeal to the city to have the original 1961 views restored. There is also a separate and less complicated “view preservation” portion of the ordinance that simply allows residents to petition neighbors to restore their views back to those that were there in 1989.
